HIPAA Compliance & Business Associate Agreements
All medical division personnel are trained in HIPAA Privacy and Security Rules. Business Associate Agreements (BAAs) are executed with every healthcare client. PHI is handled with minimum necessary standard protocols at all times.

HIPAA — Health Insurance Portability and Accountability Act

Bryktek Logistics operates as a HIPAA Business Associate when handling Protected Health Information (PHI). We maintain full compliance with the HIPAA Privacy Rule (45 C.F.R. Part 164, Subpart E), the Security Rule (45 C.F.R. Part 164, Subpart C), and the Breach Notification Rule. All medical division personnel execute individual confidentiality agreements. Business Associate Agreements (BAAs) are executed with all healthcare clients prior to service commencement. PHI is handled under the minimum necessary standard at all times — drivers are not provided with patient identifiers beyond what is strictly required for delivery purposes.

OSHA Bloodborne Pathogens Standard (29 C.F.R. § 1910.1030)

All medical couriers complete OSHA Bloodborne Pathogens training prior to handling specimens or biological materials. Training covers: exposure determination, universal precautions, engineering and work practice controls, personal protective equipment (PPE), hepatitis B vaccination program, post-exposure evaluation procedures, and recordkeeping requirements. Certifications are renewed annually and maintained in personnel files.

PHMSA / DOT Hazardous Materials Regulations (49 C.F.R. Parts 171–180)

Infectious substances (UN 2814, UN 2900), biological substances Category B (UN 3373), and regulated medical waste (UN 3291) are subject to HMR requirements in both intrastate and interstate transportation. Bryktek maintains written policies for: hazard classification, packaging to specification, hazard communication and labeling, driver training per 49 C.F.R. § 172.704, chain-of-custody for regulated materials, spill response procedures, and temperature monitoring where required. Only drivers with current DOT Hazmat certification are assigned to loads involving regulated materials.

Texas DSHS Licensing — Medical Devices & Drug Distribution

Texas Health & Safety Code Chapter 431 and Chapter 441 require licenses for the distribution of prescription drugs and medical devices in Texas. Bryktek maintains both its Texas Drug Distributor License and Texas Medical Device Distributor License through the Texas Department of State Health Services. Licenses are renewed per DSHS requirements and kept current at all times. Copies of current licenses are available to clients upon request.

Texas Intrastate Motor Carrier Operations — TxDMV

For cargo and delivery operations conducted within the State of Texas under Bryktek's own authority, the company complies with Texas DMV motor carrier registration requirements. This includes vehicle registration under commercial carrier authority, annual operating authority renewal, vehicle inspection compliance, and applicable cab card requirements for commercial vehicles.

Federal Motor Carrier Safety Regulations (FMCSR) — Where Applicable

For vehicles meeting thresholds under 49 C.F.R. Part 390, Bryktek maintains a valid USDOT Number and adheres to applicable FMCSR requirements including: driver qualification files (49 C.F.R. Part 391), vehicle maintenance records (49 C.F.R. Part 396), hours-of-service regulations (49 C.F.R. Part 395), and drug and alcohol testing programs (49 C.F.R. Part 382) for safety-sensitive employees.

Auto Parts Logistics — Hazardous Materials Considerations

Certain automotive materials constitute hazardous materials under 49 C.F.R. Parts 171–180, including lithium-ion batteries, flammable liquids, and corrosive materials. Bryktek identifies applicable HMR requirements for each auto parts load, ensures regulated materials are only handled by hazmat-certified drivers, and maintains current PHMSA training records for all personnel assigned to such deliveries. Non-spillable batteries, oils, and standard automotive fluids are handled under general carrier best practices including secure packaging, spill containment, and safe loading procedures.

HIPAA Business Associate Status & Obligations

As a medical logistics provider that handles, transports, or has access to Protected Health Information (PHI) on behalf of Covered Entities, Bryktek Logistics operates as a HIPAA Business Associate under 45 C.F.R. § 160.103. We are obligated to: (1) use and disclose PHI only as permitted or required by the Business Associate Agreement or applicable law; (2) implement appropriate administrative, physical, and technical safeguards to protect PHI; (3) report any breach of unsecured PHI to the Covered Entity; and (4) ensure any subcontractors that create or receive PHI on our behalf agree to the same restrictions.

Business Associate Agreement (BAA) Requirements

A signed Business Associate Agreement is required from all healthcare clients prior to the commencement of any medical logistics services involving PHI. The BAA establishes: permitted and required uses and disclosures of PHI; Bryktek's obligations to safeguard PHI; requirements for subcontractors and agents; breach notification procedures; and terms for return or destruction of PHI upon termination. Bryktek's standard BAA is compliant with 45 C.F.R. § 164.504(e).

Minimum Necessary Standard & Driver Confidentiality

Bryktek limits PHI provided to drivers and dispatch to the minimum necessary to accomplish the delivery — typically limited to the name and address of the recipient and the nature of the materials (e.g., "laboratory specimen"). Drivers do not have access to patient diagnoses, test results, or detailed health records. All medical division drivers execute individual confidentiality agreements and receive annual HIPAA refresher training. Violations of the confidentiality agreement result in immediate removal from medical division assignments.

Commercial Auto Insurance
Minimum $1,000,000 per occurrence. Covers all Bryktek vehicles in commercial operation across all service divisions. Certificates of Insurance provided to clients upon request.
General Liability Insurance
Minimum $1,000,000 per occurrence. Covers third-party bodily injury and property damage arising from Bryktek's operations. Additional insured endorsements available for contract clients.
Cargo / Inland Marine Insurance
Coverage for goods in transit across all service divisions — medical supplies, pharmaceuticals, cargo, and auto parts. Clients may request written confirmation of coverage limits applicable to their shipments.
Workers Compensation
Maintained per Texas state requirements for all covered employees. Ensures drivers and staff are protected in the event of workplace injury without client exposure.
Limitation of Liability
Bryktek's total liability for any claim shall not exceed the total fees paid by client in the three months preceding the claim. Client is responsible for ensuring items are properly packaged and labeled prior to pickup.
Certificate of Insurance
Certificates of Insurance are provided to clients upon written request and are available to verify coverage for all active policy types. Additional insured endorsements may be arranged by contract agreement.
